These Terms of Service (“Terms”) constitute a legally binding agreement between you and Yellow Cab of Boise LLC, an Idaho limited liability company (“Yellow Cab of Boise,” “Company,” “we,” “us,” or “our”). By accessing this website, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the website.

1. The Company and the service

Yellow Cab of Boise provides local transportation originating in Boise, Idaho, and related trips as arranged by telephone. This website is an informational and request channel. Submitting a form or asking a question does not create a reservation and does not hold a vehicle until the Company speaks with you and accepts the trip.

Payment is due at time of service, in person. You cannot pay on this website. We may refuse a trip for safety or operational reasons. We do not warrant against delay caused by traffic, weather, airport operations, or other events outside our reasonable control.

2. SMS terms — Yellow Cab of Boise Owner Alerts

The following terms govern the Company’s transactional SMS program. They are intended for A2P 10DLC campaign review and are controlling as to text messages.

Program name: Yellow Cab of Boise Owner Alerts.

Identity of sender: Yellow Cab of Boise LLC. Messages originate from (208) 279-5250.

Who receives messages: Only a Company-enrolled mobile number used for dispatch alerts. This program is not a customer marketing list. Customers are not enrolled. The public website form is a request for a telephone callback and does not constitute SMS consent.

Program description: When a customer calls and a reservation or caller message is captured, the Company sends a short transactional summary to the enrolled Company number so the ride or callback can be fulfilled.

Consent: Prior express consent is obtained when the Company enrolls a Company mobile number and enables Owner Alerts. There is no public web form and no customer keyword opt-in for this campaign. Consent applies only to this campaign, is not transferable, and is not assignable. The enrolled number must belong to an adult eighteen (18) or older.

Frequency and rates: Message frequency varies with incoming calls and reservations. Message and data rates may apply. Consent to receive texts is not a condition of obtaining transportation as a customer.

HELP: Reply HELP to (208) 279-5250. Automated HELP reply: “Yellow Cab of Boise Owner Alerts. Transactional reservation/call notices to the enrolled Company number. Msg & data rates may apply. Reply STOP to opt out. Call (208) 333-0333.”

STOP / opt-out: Reply STOP to (208) 279-5250. Automated STOP reply: “Yellow Cab of Boise: You are unsubscribed from Owner Alerts. No more messages will be sent.” Additional carrier opt-out keywords (including STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT) are honored. After opt-out, no further program messages will be sent unless the number is later re-enrolled (for example by START, if offered).

Carrier disclaimer: Wireless carriers are not liable for delayed or undelivered messages.

Privacy: Mobile information is handled as stated in our Privacy Policy at https://www.yellowboisecab.com/privacy-policy. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

3. Website use

You may use this website only for lawful purposes and in a manner that does not impair the site or other users. We may modify, suspend, or discontinue any part of the website at any time.

4. Disclaimers

THE WEBSITE AND SMS PROGRAM ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free electronic communications.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YELLOW CAB OF BOISE LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF THE WEBSITE OR FROM DELAYED OR UNDELIVERED TEXT MESSAGES, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. Nothing in these Terms limits liability that cannot be limited under Idaho law.

6. Indemnity

You agree to indemnify and hold harmless Yellow Cab of Boise LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the website or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

7. Governing law; miscellaneous

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules, except where federal law controls. If any provision is held unenforceable, the remaining provisions continue in effect. These Terms, together with the Privacy Policy, are the entire agreement as to the website and the Owner Alerts program. We may update these Terms; the effective date will change and the current version will remain posted at this public HTML URL.
